- On October 1, 1996, President Clinton
signed into law the Bill Emerson Good Samaritan Food Donation Act to
encourage donation of food and grocery products to non-profit
organizations for free distribution to needy individuals. This Act
was established to protect all good faith donors from liability as
long as the food, at time of donation, was considered safe for human
consumption.
The Emerson Act also provides protection for food and grocery
products that meet all quality and labeling standards imposed by the
federal, state, and local laws and regulations.
The Food Bank collects unmarketable but still edible food from all
segments of the food industry – processors & manufacturers,
food brokers, growers, and retailers & wholesalers.
We are happy to accept food and non-food items that are:
mislabeled
discontinued
underweight packaging
nearness
of “best used by” dates
shipping
errors
cosmetically damaged packaging
production flaws
surplus
production
un-harvested or overripe product
